NECC Settlement Distribution Letters Being Sent

         Letters have started to go out from Epiq, the claims administrator on the NECC bankruptcy settlement. Foley & Small has been informed that the per-point dollar allocation is expected to be between $2,300.00 and $2,600.00. 

Negotiations with CMS, the lien administrator for Medicare, have been ongoing. There has been substantial progress in the negotiations with CMS regarding any Medicare liens that might attach to an individual who received an NECC injection. In addition to the efforts with Medicare, other efforts have and will be undertaken with respect to liens by private insurance carriers which covered costs for client treatment for injuries from an NECC injection.
Foley & Small will keep you apprised of new developments concerning the timing of issuing payments. We will also keep you apprised of the steps that continue to be taken in the claims being asserted against OSMC and against the South Bend Clinic by our office in the state courts here in Indiana.
