Foley & Small recently settled a winter slip and fall claim. The client was a resident at an apartment complex and fell attempting to walk to the mailbox. It was asserted that the complex failed to utilize best practices for snow and ice management resulting in the failure to address the dangerous icing conditions. Expert testimony was obtained on the best ice and snow management practices to be utilized by commercial property owners to provide for the safety of their guests and tenants. The terms of the settlement are confidential.
