News - Foley & Small Handling Wrongful Death Claim
Foley & Small is representing the family of the man who was tragically killed while driving to work. He was headed northbound on State Road 39 and attempted to pass through the intersection with US 30. The intersection is controlled by a traffic light. Witnesses indicate that our client had the green light that the semi tractor-trailer the red light, though the driver of the semi tractor indicates when he last saw the light it was green. The insurance carrier for the trucking company and its driver have asserted that the collision was caused due to defects with the operation of the traffic control signal at the intersection. This has brought other defendants into the case who are said, by the trucking company and its driver, to have been at fault with respect to the traffic control light supposedly also shining green for the trucker as he approached the intersection. The case is pending in Laporte County and is set to go to trial in early 2014.
