News - Complaint Filed Against OSMC on Contaminated Epidural Injections
Foley & Small has filed with the Elkhart Superior Court a complaint OSMC – The Orthopedic and Sports Medicine Center located in Elkhart. The complaint is filed on behalf of more than 100 people who have been affected by receiving contaminated epidural injections at OSMC. Of this group, 69 persons received contaminated injections. The remaining plaintiffs are either the spouse, parent or surviving family members of those who received the injections and whose lives have also been greatly affected by having to contend with the injuries or death suffered by their family member. Three of the claimants died as result of complications from having received the contaminated NECC injections from OSMC. A great number of our clients were hospitalized as result of their exposure and the complications stemming from it. We have clients still dealing with the fungal infection resulting from the injection. A number of our clients have incurred hospital expenses in the hundreds of thousands of dollars and are still under treatment. It is alleged in the complaint that OSMC engaged in negligent purchasing practices in its acquisition of products from NECC.
