News - NECC Bankruptcy Claim Payments Slow Coming

Payments have been slow in coming to those injured by the contaminated epidural injections sold and distributed by the New England Compounding Center. To date, only 275 checks have been sent to the 1st group of 1,199 approved claimants.  Additional lien processing letters are to be issued by the Tort Trustee to move the payment process along for those in this group.

Between March 2016 and September 2016, another 780 claims for compensation were approved by the National Settlement Administrator. The lien clearance process on the other 780 claims is purportedly underway.  
Foley & Small has been told that the majority of first payments to claimants should be made by year-end, but the small number of payments made to date leads to skepticism on whether that representation will prove true.  Foley & Small may file a motion with the MDL court in late November addressing the delay in payments if adequate progress in the issuing of payments is not seen by that time.
