Foley & Small donating funds for renovation of Old St. Joseph County Courthouse
02/18/2000 Foley & Small will be making a sizable donation to the Old St. Joseph County Courthouse Restoration Fund. The Fund is to provide monies necessary to restore the old courthouse on Lafayette Boulevard in South Bend, which was constructed in the 1800\'s and is on the National Historic Register. The building will be restored to make it a working courthouse once again providing needed courtroom space for St. Joseph County.

Foley & Small obtains settlement by mediation of case for client with medical expenses of more than $150,000
02/10/2000 Doug Small was able to achieve a settlement for our client by mediation where injuries were suffered in an intersectional accident in South Bend. The client suffered a severe cervical spine injury requiring multiple surgical procedures and incurred medical bills of more than $150,000. The overall terms of the settlement were made confidential.

  1. Verdict of $2.8 Million for Foley & Small Clients Affirmed on Appeal
    Foley & Small completed the appeals process on a $2.8 Million jury verdict obtained by Ed Foley in a trial in the LaPorte Superior Court. The case involved two wrongful death claims brought against an inspection firm of an industrial boiler. The boiler exploded causing several deaths and injuries to others. Foley & Small had previously obtained settlements from other defendants and the case proceeded to trial against a single defendant, the boiler inspection company. The case was tried in the LaPorte Superior Court and spanned a two week period. After the verdicts, the boiler company appealed to the Indiana Court of Appeals, which court affirmed the decision of the jury in trial court. The appeal was then taken to the Indiana Supreme Court with the same beneficial results for the clients of Foley & Small. The verdicts have now been fully satisfied and paid.

     
  2. Foley & Small Contributes to the Northern Indiana Center for History
    Foley & Small donated funds to the Northern Indiana Center for History and participated at its Fall, 2003 fund raising event. The Center of History owns the Oliver Mansion in South Bend and has an adjacent exhibit hall only recently constructed. The hall is a state of the art facility.   3. Foley & Small Obtain Settlement of Claim Involving a Lumbar Disc Disruption
    Foley & Small obtained a notable settlement on a client’s claim arising from a motor vehicle accident in Elkhart, Indiana. This client suffered injury to her lumbar spine which necessitated a two-level lumbar fusion at the L3-4 and the L4-5 disc spaces. The case was unable to be settled prior to filing suit. After suit was filed with an approaching trial setting, the case finally proceeded to mediation. After an all day mediation session, the case was ultimately settled. While the specific terms of the settlement cannot be disclosed due to a confidentiality clause, it can be reported that the settlement involved not only a cash payment but also the purchase of a structured annuity that would pay additional funds to the client on a tax free basis over the course of many years.

     
  4. Foley & Small is a Benefactor to Public and Private School Events and Programs
    Foley & Small donated thousands of dollars in support of programs and special events by public and private schools throughout North Central Indiana. These donations benefit academic, athletic and other extracurricular activities.

     
  5. Foley & Small Obtains Excess Verdict Against Allstate Insurance and Its Insured
    Doug Small obtained a verdict of $225,000 in a claim brought on behalf of our client injured in an automobile accident involving another vehicle owned and operated by an insured of Allstate. The defendant driver had policy limits of $100,000. Plaintiff suffered a finger fracture, torn tendons on another finger, a separated shoulder, rib fractures and a left neumothorax. Medical bills were in excess of $27,000 and the loss of pay claim of over $3,000. Allstate’s maximum offer on the claim was $64,000, which was rejected. The case proceeded forward to trial before the St. Joseph Superior Court with a verdict being entered favorably in Foley & Small’s client for $225,000, $125,000 more than the liability limits on the Allstate policy.

     
  6. Foley & Small Obtains Excess Verdict of $55,000 Against Allstate Insurance and Its Insured.
    In a case tried before the St. Joseph Circuit Court, Doug Small obtained a verdict of $55,000 for our client in a motor vehicle accident case. The client had suffered various strains and contusions from the collision, but also suffered a permanent injury to her auditory system, tinnitus, or a constant ringing in her ears. The client had incurred medical expenses of approximately $6,000. The liability limits under the policy issued by Allstate to its insured were only $25,000. Allstate offered $17,000 to settle the case prior to trial, which was rejected. After a three day jury trial, a verdict of $55,000 was rendered. Allstate eventually agreed to a settlement and payment on the judgment, which was $30,000 more than its policy limits, prior to the initiation of appeal and the assertion of bad faith claim against Allstate.

     
  7. New Foley & Small Website to be Released for Use, Spring, 2004
    Foley & Small has undertaken a major upgrade and redesign of its website for use by its clients and prospective clients. The new website was designed by Bodkin Associates of Zionsville, Indiana. It provides state of the art information, displays and illustrations and communication methods along with links to various other legal related sites.

     
  8. Employment Landmarks for Staff Members of Foley & Small
    Foley & Small is blessed to have an outstanding staff to assist in the handling of claims and related matters. Bev Paluzzi completed her ninth year with Foley & Small, and has been practicing with Mr. Small for an even longer period. Bev has been working with Mr. Small for 18 years. Kim Mrozinski just completed her eighth year with Foley & Small. Kim has also been working with Mr. Small for an even longer period. She has been providing assistance to Mr. Small for 13 years. Lynn Hess completed her seventh year with Foley & Small and her career as a legal secretary now spans 10 years. Juliet McDowell, who works with Foley & Small on a part-time basis, has been with the firm for eight years. She has been a legal secretary for many years including work as a secretary for the United States State Department and worked throughout Europe. Patti Watson completed her sixth year of secretarial work with Foley & Small. For her career, Ms. Watson has been a legal secretary for 16 years.
