Kugel Hernia Patch DefectsDavol, Inc. is a Rhode Island corporation which, along with C.R. Bard, Inc., a New Jersey corporation, are involved in the manufacture and distribution of a medical implant product known as the Kugel Hernia Patch. The Kugel Patch consists of three components: (1) a polypropylene layer that faces the area of the incision and is to adhere to the abdominal wall, (2) an expanded synthetic layer which faces away from the incision and is to minimize tissue attachment or adhesion to the patch and (3) Kugel patches have a so-called “memory recoil ring” imbedded near or along the outer edges of the patch which is to pop open or hold the Kugel patch in shape for its eventual attachment.
Davol and Bard have had to recall many sizes and lot numbers of the Kugel patch and have done so pursuant to a FDA Class I recall notice. The primary defect has been in the memory coil ring which can break, resulting in two sharp edged ends of the fractured ring that can cut or puncture organs and tissues in the abdomen. A variety of problems can result as a result of the fracture or buckling of the memory recoil ring, including movement of the ring within the abdomen, bowel perforation, intestinal fistulae, infection and even deaths have been reported.
Thousands of cases have been filed across the United States involving failures of implanted Kugel patches. Cases have been filed in state court in Rhode Island and New Jersey where the corporate headquarters of the two defendants are located. In addition, in federal court, a multi district litigation proceeding has been formed.
